Alaska Man Charged with DUI on Shopping Cart

Police arrested a 63-year-old Fairbanks man accused of driving a motorized shopping cart while under the influence of alcohol

FAIRBANKS - Police arrested a 63-year-old Fairbanks man accused of driving a motorized shopping cart while under the influence of alcohol.
Merrill Moses was also charged with shoplifting and refusing to take an official sobriety test.
Police Sgt. Bruce Barnette says a grocery store employee called police after seeing Moses drive into parking lot traffic.  When an officer arrived, an employee was holding onto the cart to stop Moses.
The officer was told that the man repeatedly drives drunk on the shopping cart, and that he has previously tried to hit store employees who try to stop him.
The News-Miner reports that a preliminary test measured his breath-alcohol content at 0.31 - about four times the legal limit of 0.08 percent.

The Fairbanks cops now have nothing better to do than arrest cripples for driving motorized wheelchairs? Suggest you read the Americans With Disabilities Act first. Suggest the Fairbanks police reads the DUI statute since an electric shopping cart is a motorized wheelchair, not a motor vehicle.

According to Alaska statute law, a person using "special equipment for mobility" is legally defined as a "physically disabled pedestrian" NOT a "motor vehicle operator" Sec. 09.65.150. Duty to disabled pedestrians. (b) In this section (1) physically disabled pedestrian" means a person who has a physical condition that limits the person's ability to function as a pedestrian without the assistance of another person, a service animal, a cane, or other equipment or device;

I dunno, sounds like he was wasted, shoplifting, and generally causing a public nuisance. Where was he going? Back to his car? Or was he going to ride his scooter all the way home?
