MISSOULA- Russell Smith, 48 is charged with incest after relocating from Alaska to Montana.

Court documents show Smith moved to Missoula from Alaska to live with his biological daughter and her roommate.

Police were called to the home after the rommate reported they were having sex. She also says the two were planning to get married.

Smith's daughter confirmed the accusations to police. Prosecutors say the daughter does have a mental disability.

Smith denied sleeping with his 19-year-old daughter; however, one of his other children told investigators Smith shared a bed with the daughter.

His bail was set at $50,000 and he is scheduled to appear in court again later this month.
