(Anchorage, AK) A homeless man faces a judge, after police accuse him of sexually assaulting a woman in town square.
Charging documents say an officer interrupted 42-year-old Earl Vrooman Junior, allegedly in the act against a 22-year-old female identified as J.C.
This is a class B felony, carrying a maximum of 10 years and a $100,000 fine according to officials.
What seems to stand out in this case, is the fact police say the alleged assault happened in broad day light, in a very public place.
"It was a very nice sunny day yesterday when this was going on, " Said Sgt. Ken McCoy for the Special Victims Unit, Anchorage Police Department.
Last night shortly before 8pm, police say a citizen flagged down an officer--to go town square.
"The citizen informed him, that there was a women passed out in the area, and there was a male engaging in sex with her," McCoy said.
Documents say both smoked spice, an illegal synthetic marijuana, causing the female to have an extreme reaction.
"She is stable and has been released from the hospital, at the time of the incident though, she was completely incapacitated, and was unable to move or speak, or function at all," said McCoy.
Victim and suspect met in the park---according to officials and didn't know each other before, but what's hard to believe for some, is how only a few saw the incident, during a bright sunny Alaska evening.
"Actually I believe there might have been other people who witnessed this act taking place and we are asking anyone who did see this, to contact us because we would be interested in talking to them," McCoy said.
The DA says the suspect does have a prior record--which includes sexual assault in the third degree, back in 2001.

Vrooman is being held on $15,000 bail. He is slated for another hearing tomorrow.
