Judge Rules that Assault Suspect is Competent

A Fairbanks judge has decided that a 77-year-old man is competent to stand trial on felony assault charges.

FAIRBANKS- A Fairbanks judge has decided that a 77-year-old man is competent to stand trial on felony assault charges.

 

Superior Court Judge Michael McConahy ruled Monday that Stanley Pieniazek is competent to assist in his defense against charges that he fired shots at Alaska State Troopers in May 2012.

 

Troopers say Pienizak refused to get out of a truck camper on a street northeast of the University of Alaska Fairbanks., flashed a gun and fired shots. Troopers fired back. No one was hurt.

 

Pienizak moved from Poland to Alaska around 1970 and become a U.S. citizen.

A defense psychologist testified that Pieniazek has Alzheimer's disease and is losing his social and language skills.

 

A prosecution psychologist says Pienizak is lying about symptoms to avoid prosecution.
