Nicholas Howard has been found guilty by a military court of first degree sexual assault. The Former Marine Recruiter may never go to jail .

Convicted May 3, 2013 in San Diego, Howard has been stripped of his rank and dishonorably discharged . The former Marine recruiter was not sentenced to time in jail. Prosecutors had asked for 5 to 7 years .

The Alaska State District Attorney may still pursue a new trial. Presently they are waiting to see the transcript of the Court Martial, and review the DNA material again before moving forward with charges.

When Howard was arrested for the crime in 2011 the state crime lab was back logged. The Anchorage Police agreed to the Marines taking the case, for expediency sake.
