Court Rejects Appeal of Wasilla Homicide Lawsuit

ANCHORAGE - The Alaska Supreme Court says the children of a woman killed by her husband at the home of a friend can't collect damages from the homeowner.

Justices in an opinion released Friday say the homeowner did not have a duty to control her guests' conduct and could not have foreseen that dancing suggestively with the other woman could have provoked the killing.

The civil lawsuit stems from a December 2006 homicide near Wasilla.

Forty-seven-year-old Jeffrey Evans watched his wife, 32-year-old Carrie Randall-Evans, dance with and kiss 49-year-old Simone Greenway in a way that Greenway acknowledged was meant to tease the jealous husband.

Evans left the room and returned with a handgun that he used to kill his wife, wound Greenway and another guest, and then kill himself.
