The ACLU of Alaska is suing the state to have medical records returned to 9 patients. 

A health clinic in Ketchikan was part of a medicare fraud investigation in which the records were siezed.

The civil rights group claimed that the patients' right to privacy were violated because only financial and prescription records were needed in the fraud case.

Lawyers for the state said that proper procedusres were followed and only a few  people even saw the files.

If a summary judgment isn't issued, the case could go to trial.
